50.0.12R1. For the purposes of sections 50.0.3, 50.0.4, 50.0.5, 50.0.6, 50.0.8 and 50.0.11 of the Act, the motor vehicles that constitute prescribed motor vehicles are motor vehicles, other than those not used for commercial purposes and used exclusively for recreational purposes by a person, which are used, designed or maintained to transport passengers or goods and which, as the case may be:
(a)  have 2 axles and whose gross weight is greater than 11,797 kg;
(b)  have 3 axles or more, whatever their weight;
(c)  are used in combination with another motor vehicle and the gross weight of the combined motor vehicles is greater than 11,797 kg.
For the purposes of the first paragraph, the expression “gross weight” means the weight of a motor vehicle and its load that is indicated on the vehicle’s registration certificate. However, in the absence of such an indication or where the weight of a motor vehicle and its load, without regard to the vehicle’s registration certificate, is greater than 11,797 kg, the expression means the weight of the vehicle and its load.

However, in the absence of such an indication or where the weight of a motor vehicle and its load, without regard to the vehicle’s registration certificate, is greater than 11,797 kg, the expression means the weight of the vehicle and its load or its load capacity.
